Stallholder Terms & Conditions
By submitting an application to trade at a Franco Markets event, the stallholder (“you”) agrees to the following Terms & Conditions.
1. Participation at Own Risk
All stallholders participate in Franco Markets events entirely at their own risk.
Franco Markets, its owners, employees, contractors, volunteers, and venue partners accept no responsibility or liability for any loss, damage, injury, illness, or harm suffered by stallholders, their staff, helpers, or any third party in connection with participation in an event.
2. Loss, Damage & Theft
Franco Markets is not responsible for:
Theft, loss, or damage to stallholder stock, equipment, displays, or personal property
Damage caused by other stallholders, customers, weather conditions, venue conditions, or third parties
Stallholders are responsible for securing their own property at all times.
3. Personal Injury & Public Safety
Stallholders acknowledge that market events involve public interaction, manual handling, uneven surfaces, crowd movement, and exposure to weather conditions.
Franco Markets accepts no liability for personal injury, illness, or physical harm suffered by stallholders, their staff, helpers, or members of the public arising from participation in an event.
Stallholders must ensure that:
Their stall setup is safe, stable, and securely weighted.
Walkways remain clear and free of hazards
All electrical equipment is tested, tagged and used safely
4. Insurance
Stallholders are strongly advised to hold their own public liability insurance and any other insurance relevant to their activities, products, or services.
Franco Markets and/or the venue host does not provide insurance coverage for stallholders.
5. Weather, Event Changes & Cancellations
Franco Markets events may proceed in varied weather conditions.
Stallholders acknowledge that:
Weather conditions and environmental factors are outside the control of Franco Markets
Events may be delayed, modified, postponed, relocated, or cancelled due to weather, safety concerns, venue requirements, or other operational reasons
6. Cancellations, Refunds & Credits
Stallholder fees are generally non-refundable once a booking has been confirmed.
6.1 Stallholder Cancellation
If a stallholder cancels their booking after the time of confirmation:
A cancellation fee of 30% of the total booking fee will apply; and
The remaining balance will be refunded to the stallholder.
If a stallholder cancels within five (5) days of the scheduled event date:
No refund will be provided; and
A credit will be applied for use at a future Franco Markets event.
Any credit issued under this clause:
Is non-transferable
Has no cash value
Must be used within six (6) months from the date of the cancelled event
6.2 Event Cancellation or Postponement by Franco Markets
If an event is cancelled or postponed due to weather conditions or other circumstances beyond the reasonable control of Franco Markets:
Stallholder fees will not be refunded; however
A credit will be applied for use at a future Franco Markets event.
Franco Markets will aim to provide as much notice as reasonably possible of any event cancellation or postponement. Notice may be given by any one or more of the following methods:
Phone
Social Media
Verbal instructions provided on-site (if applicable)
Any credit issued under this clause:
Is non-transferable
Has no cash value
Must be used within twelve (12) months from the date of the cancelled or postponed event
6.3 No Cash Refunds
No cash refunds will be provided in any circumstances except where expressly stated above or where required by law.
7. Force Majeure (Events Beyond Control)
Franco Markets will not be liable for any failure, delay, cancellation, or modification of an event due to circumstances beyond its reasonable control, including but not limited to:
Extreme weather events
Government restrictions or directives
Public health orders
Acts of God
Venue closures
Power outages
Industrial action
8. Drug, Alcohol & Smoking Policy
Franco Markets events are drug-free, alcohol-free, and smoke-free environments.
Stallholders, their staff, helpers, and representatives must not:
Bring, consume, distribute, or be under the influence of alcohol at any Franco Markets event or venue
Bring, possess, use, or distribute illegal drugs or prohibited substances
Smoke or vape within any Franco Markets venue, event space, or designated event area
Any stallholder found to be in breach of this policy may be immediately removed from the event without refund, and may be excluded from future Franco Markets events.
9. Code of Conduct
Stallholders must:
Conduct themselves in a professional, respectful, and courteous manner
Treat customers, staff, other stallholders, and venue personnel with respect
Refrain from aggressive, unsafe, discriminatory, or inappropriate behaviour
Franco Markets reserves the right to remove any stallholder who breaches this Code of Conduct immediately and without refund.
10. Compliance with Laws & Instructions
Stallholders must:
Comply with all applicable laws, regulations, and venue rules
Follow all reasonable directions given by Franco Markets staff or venue management
Ensure that products sold are lawful, safe, and accurately represented
Failure to comply may result in removal from the event without refund.
11. Indemnity
To the maximum extent permitted by law, the stallholder agrees to indemnify and hold harmless Franco Markets from any claims, losses, damages, liabilities, or expenses arising from:
The stallholder’s participation in the event
The stallholder’s products, conduct, or activities
Any breach of these Terms & Conditions
12. Photography & Marketing Consent
Stallholders consent to:
Being photographed or filmed during Franco Markets events
The use of such images or recordings for marketing, promotional, and social media purposes
This consent applies without compensation and may include images of stalls, products, and people present at the event.
13. Acceptance of Terms
By submitting an application and participating in a Franco Markets event, the stallholder confirms that they have read, understood, and agree to these Terms & Conditions.
